SAMPIT, RAKYATKALTENG – Rancangan peraturan daerah (Raperda) Kabupaten Kotawaringin Timur (Kotim) tentang rencana detail tata ruang kawasan peruntukkan industri Bagendang tahun 2020-2040 akkhirnya ditarik dari DPRD Kotim. Hal ini menyusul dengan arahan pemerintah pusat bahwa kebijakan itu seiring dengan munculnya UU cipta kerja.
Dikatakan oleh Bupati Kotim Halikinnor melalui Wakil Bupati Kotim Irawati, akan tetapi seiring dengan berjalannya waktu terdapat perubahan peraturan perundang-undangan dengan terbitnya UU nomor 11 Tahun 2020 tentang cipta kerja yang mana di dalamnya terdapat perubahan terhadap UU Nomor 26 tahun 2007 tentang penataan ruang.”Yang salah satunya mengatur bahwa rencana detail tata ruang diatur dengan peraturan kepala daerah,”sebutnya, Sabtu (29/5/2021).
Lanjutnya, dalam rangka melaksanakan UU Nomor 11 tahun 2020 tentang cipta kerja telah ditetapkan peraturan pemerintah Nomor 21 tahun 2021 tentang penyelenggaraan penataan ruang, yang pada pasal 85 ayat (1) huruf D menegaskan kembali bahwa penetapan rancangan peraturan kepala daerah Kabupaten/Kota tentang rencana detail tata ruang oleh Bupati/Wali Kota sesuai dengan perserujuan subtansi oleh menteri.
“Hal ini juga telah melalui pembahasan pada rapat kerja badan pembentukan peraturan daerah DPRD dengan pemerintah daerah pada Senin 19 April 2021, yang hasilnya disetujui bersama untuk dilakukan penarikan terhadap rancangan Perda Kabupaten Kotim tentang rencana detail tata ruang kawasan peruntukkan industri bagendang tahun 2020-2040,” tegasnya.
Menurutnya, dengan ditetapkannya peraturan kepada daerah berdasarkan peraturan perundang-undangan yang berlaku.”Berdasarkan hal-hal tersebut, maka perlu dilakukan penarikan terhadap rancangan perda Kabupaten Kotim tentang kawasan peruntukkan industri bagendang tahun 2020-2040,” sebut Irawati.
Sementara itu Ketua Bapemperda DPRD Kotim, Handoyo J Wibowo menyebutkan penarikan kembali raperda itu memang hak dari eksekutif. Raperda itu nantinya akan berubah hanya menjadi peraturan kepala daerah. Apabila demikian maka tidak perlu lagi dibahas ditingkat DPRD. “Karena arahan dari pemerintah pusat itu akan dituangkan dari sebuah perkada jadi bukan perda yang mesti dibahas di DPRD lagi,”kata Handoyo.
